This End User License Agreement (“EULA”) applies to AICATCHER, VoxGazer and other downloadable or installable applications, server software, SDKs, plug-ins, updates and related documentation provided by AISRC (“Software”).

Web-based services are generally governed by the AISRC Terms of Use.

Where AISRC and a user, company, or organization enter into a separate license agreement, order form, supply agreement, or other written agreement (a “Customer Agreement”), Section 15 governs the relationship between that Customer Agreement and this EULA.

1. Application and Acceptance

AISRC will make this EULA available during an applicable download, installation, registration or activation process.

Where AISRC provides an acceptance procedure, this EULA applies when the user accepts it through that procedure.

A user acting on behalf of a company or organization represents that the user has authority to bind that organization to the applicable agreement.

2. License

The Software is licensed, not sold.

Subject to compliance with this EULA, AISRC grants the user a limited, non-exclusive and non-transferable right to use the Software for its permitted purpose and within its permitted scope.

For enterprise Software, license duration, authorized users, server or instance limits, deployment environments, processing volume and other restrictions may be specified in a separate Customer Agreement.

3. Intellectual Property

All intellectual property rights in the Software, AI models, algorithms, source code, object code, APIs, SDKs, interfaces, documentation and related technologies belong to AISRC or the applicable rights holder.

No ownership rights are transferred under this EULA.

4. Restrictions

Except where expressly permitted by applicable law or a separate written agreement, users must not:

  • sell, rent or sublicense the Software;
  • make the Software available as a standalone service to third parties;
  • reverse engineer, decompile or disassemble the Software;
  • attempt to extract source code or proprietary algorithms without authorization;
  • extract or reproduce AI model weights, parameters or other proprietary model information without authorization;
  • circumvent technical or contractual usage restrictions;
  • remove or alter copyright, trademark or other proprietary notices;
  • use the Software for unlawful surveillance, impersonation, fraud or other unlawful activity; or
  • process the personal information or voice of another person without lawful authority.

5. User Data

Rights in voice recordings and other data submitted by a user remain with the user or applicable rights holder.

Users are responsible for having lawful authority or another lawful basis to process such data through the Software.

AISRC processes personal information in accordance with its Privacy Policy and any applicable agreement.

6. AI Model Training

AISRC does not use original voice data submitted by individual AICATCHER users to train or retrain AISRC’s general AI models without separate consent or another lawful basis.

AISRC does not use an enterprise customer’s original voice data, voice feature values, case information, analysis results or reports, including data processed through VoxGazer, to train or retrain AISRC’s general AI models or for general performance improvement without the enterprise customer’s express written agreement. Any customer-specific model development, research or performance improvement separately agreed in writing will be governed by applicable law and the relevant agreement.

7. Analysis Results

AI analysis may produce false positives, false negatives and other errors.

AISRC does not guarantee detection of every deepfake, spoofing attempt, impersonation or manipulation, or correct classification of every legitimate voice.

Results are technical information intended to assist users.

Unless AISRC has separately agreed in writing to provide an expert forensic examination or expert report, automated results, including analysis results and reports generated by VoxGazer, do not constitute an expert forensic opinion, guarantee evidentiary admissibility, or constitute a legal conclusion.

Speaker comparison and identification results are statistical and technical support information and must not, by themselves, be treated as a conclusive determination of a person’s identity.

Subject to the applicable Customer Agreement and applicable law, users may use analysis results and automatically generated reports for legitimate purposes such as investigations, litigation, internal investigations, audits and recordkeeping.

8. Updates

AISRC may provide updates for security, error correction, performance or feature improvements.

Unless separate license terms are provided, this EULA also applies to such updates.

9. Open-Source and Third-Party Components

The Software may contain open-source or third-party components subject to their respective license terms.

Those terms apply to the applicable components.

10. Support and Maintenance

Support, maintenance, service levels, response times and applicable charges for enterprise customers may be specified in a separate agreement.

This EULA alone does not guarantee a particular service level, maintenance scope or support response time.

For VoxGazer and other enterprise Software deployed on premises, AISRC does not ordinarily have remote access to customer data. Technical support is provided using logs or materials supplied by the customer or through other customer-approved support procedures. Any exceptional access to customer data requires a separate written agreement with the customer in advance.

11. Suspension and Termination

AISRC may restrict use or terminate a license where a user materially violates this EULA, uses the Software unlawfully or creates a material security risk, to the extent permitted by applicable law.

Except in urgent circumstances, AISRC will use reasonable efforts to provide notice and an opportunity to remedy a breach where appropriate.

Upon termination, the user must stop using the Software under the terminated license.

12. Responsibility

AISRC uses reasonable technical and organizational efforts to provide stable and secure Software.

AISRC is not responsible for consequences resulting from a user’s unlawful processing of data, use of the Software outside the permitted scope, or independent decisions made solely on the basis of analysis results, except to the extent such consequences are caused by AISRC.

Nothing in this EULA excludes or limits liability for AISRC’s intentional misconduct or gross negligence, or liability that cannot lawfully be excluded or limited.

Specific warranties and liability limits applicable to enterprise customers may be separately agreed.

13. App Marketplaces

Where Software is distributed through the Apple App Store, Google Play or another app marketplace, mandatory terms of the applicable marketplace may also apply.

14. Compliance with Law

Users must comply with applicable privacy, intellectual property, export control and other laws in connection with their use of the Software.

Where the Software is used for criminal investigations, speaker identification or another purpose that may constitute high-impact AI under applicable law, AISRC and the user will comply with the legal obligations applicable to each of them.

15. Customer Agreements

Where a separate written Customer Agreement expressly provides terms different from this EULA, that agreement will control with respect to those terms.

Nothing in this EULA restricts rights that cannot lawfully be excluded or limited.

16. Changes

AISRC may amend this EULA where reasonably necessary in response to changes in applicable law or the Software.

Material changes affecting user rights or obligations will be communicated through the website, application or another reasonable method before taking effect.

17. Governing Law and Disputes

This EULA is governed by the laws of the Republic of Korea.

The parties will first attempt in good faith to resolve disputes through discussion. Any unresolved dispute will be submitted to a court having jurisdiction under applicable Korean law.

18. Severability

If any provision of this EULA is held invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
